1. General Information
1.1 Customer Profile: ScubaEngineer.com supplies spare parts, custom tools and the access to dive equipment service information only to businesses such as retail dive shops, charter services, dive resorts / live-aboards, scuba equipment manufacturers and distributors, government, military, public service, educational, and research diving organizations employing a formally qualified Dive Industry Technician.
1.2 Agreement Upon Access: When accessing the catalog and web pages of www.scubaengineer.com with the intention of ordering the products contained therein, you agree to all the terms listed within these terms and conditions. Do not continue if you do not agree.
1.3 Information: This web site (the “Catalog” or “Site”) has been prepared only for the purpose of providing general information to the public. This Catalog or Site is provided “as is” with no representation or warranty of any kind, either expressed or implied, having been made as to the completeness, accuracy or reliability of the information contained therein.
1.4 Catalog or Site: You expressly acknowledge that this Catalog or Site may contain incomplete information, errors, or it may be outdated. The information herein is furnished for informational use only, is subject to change without notice, and should not be construed as a commitment by Easytek Engineering Services Co Ltd (trading as ScubaEngineer.com, ScubaSpareParts.com, Easytekco.com) to assume any responsibility for any errors or inaccuracies that may appear therein. ScubaEngineer.com reserves the exclusive right to add, delete or modify any information in the Catalog and Web pages or withdraw the access to the pages at any time and disclaims any duty to update any information contained herein.
1.5 Damages in Use of Catalog or Site: ScubaEngineer.com shall not under any circumstances be liable for any direct, consequential, incidental, secondary or special damages or lost profits whether resulting from the use or inability to use this Catalog or Site, and you hereby waive release any such claim. 2. Ordering Procedures
2.0 Opening the trading account: Prior to processing the first order, the business must first apply to open a ‘trading account’ with ScubaEngineer.com during which the following conditions must be satisfied:-
2.0.1 Application: Satisfactory completion of all appropriate sections of the ScubaEngineer.com online trading account application form.
2.1 End user statement: The business must employ at least one formally trained Dive Industry Technician or other manufacturer trained service personnel. A copy of the technician’s certificate(s) must be sent with the application and will be held on file by ScubaEngineer.com
2.2 Account holder business profile: The account holder’s facility supported by ScubaEngineer.com must have established, regular business hours located in a commercially-zoned property / building and operated separately from any residence. Please mail or email:
2.2.1 A photo of store front
2.2.2 A photo of the repair facility
2.2.3 A photo of the technician’s business card that will be carrying out the repair/service actions
2.3 Taxation & Regulatory: The business must have the appropriate business licenses and tax-payer identification numbers as required by Federal/State/Local agencies.
2.4 Account Holders Activities supported: Businesses or organizations must be commercially / professionally involved in one or more of the following activities:
2.4.1 Retail selling, renting and repairing of diving equipment along with instruction and breathing gas filling services to consumers.
2.4.2 The manufacture and / or supply of diving equipment for wholesale distribution.
2.4.3 Importing and / or wholesale distribution of diving equipment to consumer, retail or commercial related diving operations.
2.4.4 Commercial underwater salvage / recovery / maintenance operations.
2.4.5 Dive resorts, live-aboards or dive charter operations.
2.4.6 Dive operations affiliated with government, military, public service, educational or research entities.
2.4.7 Retail, industrial, service or manufacturing operations with resale, commercial or production needs for ScubaEngineer.com
2.5 Web Business support: Web-only service/repair operations are not accepted at this time.
2.6 Application method: The application may be made by fax, email or regular mail means.
2.7 Misrepresentation: Misrepresented or false information supplied by a trade account applicant at the time of application, or if discovered to be as such at a later date, will result in a refusal or revocation of trade account status and refusal of any future orders. 2.8 Notarization: A trade account application, with all applicable portions completed, and a physical or “electronic” signature, must be returned to and approved by ScubaEngineer.com prior to any sale regardless of payment method.
3. Sales policy & terms
3.0 This information is supplemental to that given on any ScubaEngineer.com Price Lists and gives data particular to foreign sales. Please read the ScubaEngineer.com Price List, ScubaEngineer.com Sales Policy stated above and the following information carefully.
3.1 INTERNATIONAL SALES: ScubaEngineer.com sells its products throughout the world and invites trade account inquiries from businesses stated above in the ScubaEngineer.com Sales Policy. We do not sell directly to independent instructors, clubs, or individual divers. Many of the products which ScubaEngineer.com distributes, such as repair supplies and tools, are consumed or used by the dive business itself and are not to be resold. ScubaEngineer.com reserves the right to reject any or all orders.
3.2 TERMS: Pre-payment plus freight and incidental fees is required for all shipped goods and training courses. Payment must be made by irrevocable bank transfer. Bank transfer fees are to be paid by the trade account holder. Students may not attend training courses and parts will not be shipped until the payment has been received by ScubaEngineer.com. Downloadable software, ASSET membership renewal fees and other online products may, at ScubaEngineer.com’ s discretion, be allowed by secure online fund transfer using the popular PAYPAL system.
3.3 ORDERS & PROCEDURES: Orders must be placed by email, fax or regular mail. Please specify the desired method of shipment at the time of order. If only price quotations and shipping estimates are desired, please indicate so on your inquiry by writing “Quotation Request only”. PO
3.4 MINIMUM ORDER VALUE: The minimum order value excluding postage and packing is US$50
3.5 TRADING ACCOUNT-OPENING BALANCE:
- The minimum opening balance for all new accounts is US$100. This must be made in cash or by irrevocable bank transfer.
- Your opening balance must have fully cleared the international banking system and have actually been received by ScubaEngineer.com before your order can be shipped to you.
3.6 TRADING ACCOUNT – REFUNDING CLEARED FUNDS
- You can request a refund of the ‘cleared funds balance’ in your ScubaEngineer.com trading account at any time.

3.9.2 Bank telegraphic transfer using the SWIFT system. A copy of the bank transfer receipt must be emailed/faxed to ScubaEngineer.com as proof of payment. Note: Items will only be shipped once the payment has cleared the international banking system and the funds have arrived in our account.
3.9.3 Online banking funds transfer. Note: Items will only be shipped once the payment has cleared the international banking system and the funds have arrived in our account.
3.9.4 Pre-paid in cash US-Dollars [USD]

3.10 ORDERING AGAINST CLEARED FUNDS REQUIREMENT: At no time will an order be processed that exceeds the cleared balance in the ScubaEngineer.com trading account
3.11 ONLINE FUNDS TRANSFER TIME-SCALES:
3.11.1 Payments made using the SWIFT electronic funds transfer system represent the quickest method to establish ‘cleared funds’ in your ScubaEngineer.com trading account. Payments made by this method can sometimes take 1-2weeks to ‘clear’ the international banking systems.
3.11.2 Payments made using either PAYPAL or other online credit card funds transfer systems take approx 188days(7 months) to ‘clear’ all security checks.
3.11.3 If subsequent order payments fail for whatever reason, the order is debited against the ‘cleared funds balance’ in your ScubaEngineer.com account.
4. Shipping
4.1 FOB PORT: All shipped product is supplied Free On Board (‘FOB’) Bangkok, Thailand.
4.2 CARRIER MODE: It is the responsibility of the buyer to specify the desired mode and carrier for shipping at the time of ordering.
4.3 SHIPPING LIABILITY: Delivery to carrier specified by the customer constitutes delivery to the purchaser. Once products are delivered to the carrier – the shipment is considered delivered to the customer and we decline any responsibility from that point on.
4.4 SHIPPING COSTS: Unless otherwise stated the price of any good excludes shipping. Shipping costs are calculated at the time of dispatch. ScubaEngineer.com reserves the right to vary any published shipping charges to take into account the actual cost of shipping the item by the payment method specified.
4.5 PAYMENT REQUIREMENTS: The buyer must transfer the full cost of the goods plus any shipping charges. Goods will not be shipped unless there are sufficient cleared funds in your trading account.
4.6 DESTINATIONS OFFERED: The customer should be aware that some carriers will not insure shipments to certain destinations. Please contact your chosen carrier to check the delivery commitment for specific oversea locations.
4.7 UNINSURED SHIPMENT LIABILITY STATEMENT: When uninsurable shipments are undertaken by the customer, ScubaEngineer.com cannot be held responsible for damage, thefts, or other losses.
4.8 USE OF ALTERNATIVE CARRIERS: If the desired delivery mode is not available, ScubaEngineer.com reserves the right to use an alternative carrier.
4.10 UNDELIVERED OR DAMAGED IN SHIPMENT CLAIMS: Claims for damage or shortage must be made immediately with the carrier by yourself. If a shipment is refused or returned, all incurred shipping charges will be billed to the customer.
4.11 CARRIER CLAIMS: Claims for damage in transit must be placed with the shipping agent by yourself within 10 days of receipt of product. Shipping agents reserve the right to vary this notice period according to there operating practices.
4.12 IMPORT DUTIES: Some countries may levy import duties on imported goods; it is the trade account holder’s responsibility to pay any additional import duties, taxes, storage charges and other associated costs incurred by the chosen shipping method.
4.13 ORDER PROCESSING TIME: Items held in stock are shipped within 48 hours of receipt of a pre-paid trade account order. All orders are shipped Monday through Friday excluding holidays.
4.14 BACK ORDER & OUT OF STOCK POLICY: ScubaEngineer.com tries its best to ship all orders complete. Should an item be out of stock at the time of order, it will be automatically placed on ‘back order’ unless informed by the trade account holder. On arrival of the out of stock part it will be shipped as soon as possible using the same terms and shipping methods as the original order unless otherwise instructed.
4.14 DELIVERY TIMES: Please allow up to 30 days delivery for out of stock items. Items not immediately available with the normal 30day delivery period will be held on ‘back order’ until cancelled by the trade account holder.
4.16 POST OFFICE BOX ADDRESSES: Orders addressed to an APO, FPO, or a P.O. Box are usually sent by ‘Air Parcel Post’. Courier methods are usually not possible to these types of delivery locations.
SHIPPING METHODS OFFERED:
- UPS: Shipments are insured and traceable.
- FEDEX: Shipments are insured and traceable.
- DHL: Shipments are insured and traceable.
- EMS: Shipments are traceable but not insured (*)
- AIR PARCEL POST: Shipments are not traceable and not insured (*)
Notes:
- As per Para 4.3 “Delivery to the carrier specified by the customer constitutes delivery to the purchaser”.
- Max order value permitted via AIR PARCEL POST is USD100
5. Return Policy
5.1 CHARGES: In the event you need to return your merchandise, at our discretion, we will offer you an exchange or a refund for the cost of the product. (Note: Shipping costs will not be refunded.) ScubaEngineer.com reserves the right to charge a re-stocking fee of up to 25%, at our discretion.
5.2 ELIGIBILITY FOR RETURN: Non-stock or special order items may not be eligible for return.
5.3 RETURN METHOD: Pack the product securely in its original packing material and enclose a copy of the invoice with the item(s) you are returning circled. Please contact us via email or call/fax us Monday – Friday 8:00 a.m. to 5:00 p.m GMT+7 at +66-38-757002 for return authorization.
5.4 RESPONSIBILITY FOR PROBLEMS DURING RETURN SHIPPING: The trade account holder alone is responsible for choosing the return shipping method, and for ensuring the goods arrive safely back at our premises. The account holder is cautioned to ensure that all customs export forms and relevant shipping paperwork required for international return actions are satisfactory taken care of so as to ensure the safe, traceable, trouble free return of the goods to our premises. A courier shipping method (UPS, FEDEX, DHL) with guaranteed door to door delivery is highly recommended.
5.4 CREDIT FOR RETURNED ITEMS: The refunded value of any returned items are only credited to your account as ‘cleared funds’ on confirmed receipt of the merchandise in ‘as new’ condition at our premises.
6. Product Warranties
6.1 WARRANTEE STATEMENT: ScubaEngineer.com only warrants that all parts supplied are the original manufacturer parts, supplied in the original packaging. Warranty is limited to replacement of the spare part kit for a period of up to 90days from the date of the original purchase. During this period, ScubaEngineer.com will, at its option, repair or replace the defective product free of charge or refund the purchase price. This warranty does not apply to normal wear and tear, abuse, neglect, unreasonable use, mistreatment, failure to follow the product instructions, or consequential damage.
6.2 WRITTEN WARRANTEE REQUIREMENT: This warranty and remedies set forth above are exclusive and in lieu of all others, whether oral or written, expressed or implied.
6.3 EXTENSIONS TO WARRANTEE STATEMENT: No ScubaEngineer.com representative, dealer, agent, or employee is authorized to make any modification, extension, or addition to this warranty. ScubaEngineer.com is not responsible for special, incidental, indirect or consequential damages resulting from any breach of warranty, or under any other legal theory, including but not limited to loss of profits, downtime, goodwill, damage to or replacement of equipment and property, and any costs of procurement of substitute goods, technology, or services.
